Apple sues Motorola Mobility over patent claims in Germany



Apple has filed a law suit against Motorola Mobility in a San Diego federal court, US requesting it stop Motorola from asserting some patent claims against Apple in Germany.

Apple says that as a Qualcomm customer, Apple is a third-party beneficiary of Motorola's agreement with Qualcomm. Under that agreement, Motorola's rights under certain patents are exhausted. 

Motorola has sued Apple in a German court alleging that it infringes the '336 patent, claiming that it is not possible to practice the GPRS (General Packet Radio Service) standard of the European Telecommunications Standards Institute (ETSI), without infringing the '336 patent. Motorola has pursued an aggressive international campaign of litigation that flies in the face of its promise to license its cellular standards-essential patents on FRAND (fair, reasonable, and non-discriminatory) terms, Apple said.

Apple in the Law suit said that Motorola's German lawsuit against Apple breaches terms of a patent licensing agreement between Motorola and Qualcomm. 

All attempts to contact officials of Apple, Motorola and Qualcomm have gone futile.
